Terms and Conditions

1. The App

Nouri: Five A Day is a fruit and vegetable tracking and habit-building app for personal, non-commercial use. It helps you log daily portions, follow a daily goal, see progress and streaks, review history, and optionally use reminders and Premium features such as additional reminders, widgets, advanced insights and themes (availability depends on your purchase status and App version).

Nouri is a general wellness and lifestyle tool. It is not a medical device and does not provide medical diagnosis, medical treatment or personalised clinical dietary advice.

2. Acceptance and eligibility

You must be old enough to form a binding contract in your jurisdiction, and in any case at least 13 years old (or the higher age required where you live). If you are under the age of majority, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

You must comply with Apple's App Store terms and applicable local laws.

3. No Nouri account

Nouri does not require you to create a separate Nouri username or password. Your food logs and progress are stored locally on your device. Purchases are associated with your Apple Account through the App Store and related purchase systems.

4. Personal use licence

Subject to your compliance with these Terms and Apple's App Store rules, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the App on Apple-branded products that you own or control, solely for your personal use, as permitted by the App Store Terms of Use and Apple's Standard EULA.

You may not copy, modify, distribute, sell, rent, reverse engineer, or attempt to bypass security, purchase or entitlement controls except where mandatory law allows.

5. App functionality

Core free features typically include unlimited food logging, daily five-a-day style progress tracking, daily goals, streaks, history calendar views, basic statistics and a basic reminder, subject to the App version you use.

Nouri Premium, where purchased, is intended to unlock additional capabilities such as better reminders, widgets, advanced insights and themes. Feature availability may change as we improve the App.

We do not guarantee uninterrupted access to any feature, streak, history entry or subscription benefit. Local data may be lost if you delete the App, change devices, or experience device or operating-system issues. Back up your device according to Apple's guidance if you want to preserve data through migration or restore.

6. Wellness information — no medical advice

Nouri provides general wellness and habit-tracking tools for personal use only. Progress, goals, streaks and insights are organisational and motivational tools — not clinical assessments or personalised medical nutrition therapy.

The App is not a medical device. It does not diagnose medical conditions, prescribe diets or replace advice from a qualified healthcare professional.

Always seek the advice of a qualified professional with any questions about a medical or dietary condition. Never disregard professional advice or delay seeking it because of something you track in the App.

If you think you may be experiencing a health emergency, contact emergency services or a qualified professional immediately.

7. Nouri Premium — subscription and lifetime purchase

Nouri offers optional Nouri Premium purchases that unlock additional features. Core logging and basic progress features remain available without a purchase, subject to the App version you use.

Based on the current product configuration used by the App, Nouri Premium may be offered as:

• Monthly Premium — an auto-renewable subscription — App Store product identifier nouri.monthlymain (expected UK display price £1.99 per month); and/or
• Lifetime Premium — a one-time non-consumable purchase — App Store product identifier nouri.lifetime (expected UK display price £9.99).

There is no weekly subscription product in the current offering described by these Terms. Pricing and available purchase options are displayed by Apple in the App and on the App Store before you confirm a purchase and may vary by country and storefront. The price Apple shows at checkout is controlling.

Monthly Premium

Payment is charged to your Apple Account. The monthly subscription automatically renews unless you cancel at least 24 hours before the end of the current period (or within any different timing Apple requires). Your account is charged for renewal within 24 hours prior to the end of the current period.

You manage, change or cancel the monthly subscription in your Apple Account subscription settings (Settings → Apple Account → Subscriptions, or the equivalent path Apple provides). Cancelling renewal stops future charges but does not usually remove Premium access immediately — access generally continues until the end of the current paid period, subject to Apple billing status, refunds, grace periods and entitlement rules. Deleting the App does not necessarily cancel a subscription.

Lifetime Premium

Lifetime Premium, where offered, is a one-time purchase rather than a recurring subscription. It does not automatically renew and does not have a monthly expiration date. It grants ongoing access to Nouri's included Premium features for the supported lifetime of the App and while those features remain available, subject to valid purchase status, refunds, revocations and applicable law.

Lifetime Premium is not a guarantee that the App will remain available forever, and it does not promise that every future feature or separate product will automatically be included. Nothing in this description overrides mandatory consumer rights that apply to you.

Restore Purchases

You may restore eligible purchases through the App where Restore Purchases is available, using the same Apple Account that made the original purchase. We use RevenueCat together with Apple's systems to validate purchase and entitlement status. Temporary delays in unlocking Premium can occur. Purchases generally do not transfer between unrelated Apple Accounts.

Refunds

Refunds, billing disputes and purchase adjustments for App Store transactions are handled by Apple under Apple's refund and purchase policies, subject to any mandatory consumer rights that apply in your country of residence. Billing, renewal, cancellation and refunds are handled by Apple according to Apple's policies and applicable consumer law. We do not claim that refunds are never available.

8. Privacy

Our handling of personal information is described in the Nouri Privacy Policy at https://threetwooneglobal.com/apps/nouri-five-a-day/privacy. By using the App, you acknowledge that information will be handled as described there.

The App uses third-party service providers, including Apple, RevenueCat and PostHog, as described in the Privacy Policy.

9. Intellectual property

The App, including its software, design, branding, mascot, text, layout and other materials, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not transfer ownership of the App to you.

10. Acceptable use

You agree not to:

• use the App for any unlawful, fraudulent or abusive purpose;
• attempt to gain unauthorised access to entitlements or systems;
• misuse restore purchases or refunds in bad faith;
• interfere with or disrupt the App or other users' devices;
• use cheats, automation or modified clients to manipulate progress, streaks or purchase status; or
• use the App in any way that could create liability for us or Apple.

11. Availability and modifications

We may update, modify, suspend or discontinue the App or any feature at any time, with or without notice, where permitted by law.

We may update these Terms from time to time. When we do, we will revise the effective / last-updated date above. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.

12. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT GOALS, STREAKS, PROGRESS INSIGHTS OR OTHER OUTPUTS WILL BE ACCURATE OR SUITABLE FOR ANY PARTICULAR PURPOSE.

Nothing in these Terms affects any warranties that cannot be excluded under UK consumer law.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE (AND OUR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS AND SUPPLIERS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID US FOR THE APP OR IN-APP PURCHASES IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE CLAIM; OR (B) FIFTY POUNDS STERLING (GBP £50).

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, including liability for death or personal injury caused by negligence, or fraud. If you are a UK consumer, you have mandatory rights that these Terms do not affect.

14. Apple-required terms (iOS / App Store)

You acknowledge that:

• these Terms are between you and Three Two One Global Ltd, not Apple;
• Apple has no obligation to provide maintenance or support for the App;
• in the event of any failure of the App to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price for the App (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
• Apple is not responsible for addressing claims relating to the App or your possession or use of it, including product-liability claims, legal or regulatory claims, claims under consumer-protection law, or claims relating to intellectual-property infringement;
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary; and
• you represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.

15. Termination

You may stop using the App at any time by deleting it from your device. Deleting the App does not automatically cancel an active Apple subscription — manage subscriptions in your Apple Account settings.

We may suspend or end access to the App or features if you materially breach these Terms, where permitted by law. Provisions that by their nature should survive will survive termination.

16. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles that would require another law to apply.

The courts of England and Wales have exclusive jurisdiction, except where mandatory consumer-protection laws give you the right to bring proceedings in another jurisdiction.
